| 内容記述 | 本稿では，著作権法を中心にデジタル・ネットワーク化によって生起した知的財産権問題の現状認識と課題の抽出を行い，経済財としての「情報」の「価値」について考察を行う．そののち，現行著作権法が著作権を複製権等の支分権の集合体として構成しているのに対し，デジタル・ネットワーク化環境に著作物がデジタル化されて置かれたときは，「著作物の本饗的価植が享有されたときに著作権者の権利が働く」とする知的財産権法の可能性について論じる．さらには，創作性の有無にかかわらず「情報一般」の保護のあり方について考察する． | |||||||

| 内容記述 | In this paper, I would like to review the recognition of the status quo and the issues of intellectual property rights which have been born due to the digital networks centering around the statutes ofr copyrights and would like to go over the "value" of "information" as an economic property. Afterwards, we would like to discuss the possibility of an intellectual property rights statute which "works as a right to the copyright holder to be enjoyed as the essential value of the content" when it is digitalized in an environment of digital networks consisting of a bundle of partial rights which include the reproduction rights for the copyright used under present law. Furthermore, whether or not there is creativity, we shall consider the protection of "general information". | |||||||
