| 内容記述 | 平成15年の地方自治法の改正により導入された指定管理者制度は，自治体の個人情報保護との関係において多くの問題点を生み出している．自治体は公的機関として公共性や透明性が求められ，個人情報保護条例で個人情報保護を図っているのに対して，企業等の民間事業者である指定管理者には個人情報保護法が適用されている．本稿では個人情報の取扱をめぐる公的機関としての自治体と民間事業者との相違を明らかにし，公の施設の管理に際して指定管理者が収集・保有する個人情報に対する個人情報保護法と条例の適用問題について検討を加える． | |||||||

| 内容記述 | This study addresses some issues regarding with the Designated Administrator System established by 2003 amendment of Local Autonomy Law. Local municipals have their personal information protection ordinance to protect personal information of their inhabitants, but designated administrators are not under the regulation of the ordinance but the control of personal information protection law. This study considers the difference of handling of personal information between public sector and civil sector, and examines how to treat personal information collected and handled by designated administrator. | |||||||
