欧州・米国間では，個人データの移転のために，欧州の十分性認定制度を前提としつつも，セーフハーバースキーム，プライバシーシールドが採用されてきたが，それぞれ，欧州司法裁判所によって無効とされてきた（SchremsI，SchremsII）．プライバシーシールドに対する十分性認定が無効となったのちの，欧米間の個人データ移転のための交渉は表面化していなかったが，2022 年に入り，新たな大西洋横断データプライバシー・フレームワーク（Trans-Atlantic Data Privacy Framework）が検討されていることが公表された．本発表では，同フレームワークについて，現状と課題を述べる． |

For the transfer of personal data between Europe and the United States, the Safe Harbor Scheme and the Privacy Shield have been adopted on the premise of the EU's adequacy decision system, but these have been invalidated by the European Court of Justice (Schrems I and II). Negotiations for the transfer of personal data between Europe and the United States had not surfaced after the adequacy decision for the Privacy Shield was revoked, but it was announced in 2022 that a new Trans-Atlantic Data Privacy Framework was under consideration. This paper describes the present situation and problems of the framework. |
