| 値 | Arbitration is one of alternative dispute resolutions to litigation, based on a valid arbitration agreement between the parties. Therefore the validity and the existence of an agreement have a very important meaning, they are often challenged by the parties in litigation and/or arbitration. Code of Civil Procedure of Japan (CCP), however, has a few provisions concerning an arbitration agreement. The parties are in principle free to incorporate anything into an agreement other than CCP provides ; e.g. whom to choose and appoint as arbitrators and how to do so. Although arbitration is a voluntary dispute resolution, arbitrators must be as impartial as judges in litigation, insofar as arbitration constitutes a part of the judicial system where impartiality is an indispensable requirement. It is difficult to ensure the impartialty of arbitrators, unless a procedure for appointment is impartial in itself. Thus an arbitration agreement should be subject to such general principles in addition to some conditions stipulated by CCP. From this point of view, in this paper will be examined the problem of "partial" procedure for appointment of arbitrators through the comparison and analysis of two court cases. |
