| 内容記述 | 本研究は、1987年の精神保健法成立によって、精神障害者の人権を守るために設置された精神医療審査会が17年経過した現在どのように機能しているかを調査検討し、今後の課題を明らかにすることを目的としている。精神保健法成立後、関連する制度は大きく変容しており、精神医療審査会のあり方も再検討の時期に来ている。 たとえば、1993年に心身障害者対策基本法が障害者基本法に改正され、95年には精神保健法が精神保健福祉法となり、97年に精神保健福祉士法が制定された。さらに、2000年4月には介護保険法が実施されるとともに成年後見立法が施行され、ほぼ同時期の同年6月には社会福祉基礎構造改革関連八法が成立し、その後、市町村への分権化も進み、社会福祉の制度は大きな転換点を迎えることとなった。 このような流れの中で、精神障害者のための権利擁護の視点から、精神医療審査会の役割、その後展開してきた権利擁護のシステム・方法を総合的に見直してみた。その結果、現行の制度が抱える問題を整理し、今後の方向性をいささかなりとも指し示すことができたと考える。 |

| 値 | The purpose of this study is to examine current functions of the psychiatric review board and to identify its problems. Due to the implementation of the Mental Health Law in 1987, the psychiatric review board was created in order to protect human rights of people with mental illness. Since its legislation, various systems around people with mental illness have been changed dynamically, so the re-examination of the functions of the psychiatric review board is necessary now. For instance, the Basic Law for Persons with Disabilities was established in 1993. Also, the Mental Health Law was amended in 1995. Couple of years later, Certified Psychiatric Social Workers Law was established. As well, the Guardianship Law was put into effect in 2000 at the time of the legislation of the Long-Term Care Insurance Law. In June of 2000, eight laws on welfare services were enacted and later, decentralization was started. Accordingly, social welfare systems have come to the turning point. In this article, the authors reviewed roles of the psychiatric review board, as well as human rights protection systems for people with mental illness in a comprehensive manner. |
