| 内容記述 | 2000年4月に実施された介護保険法による契約化に続いて、同年6月に制定された社会福祉基礎構造改革関連立法によって、障害のある人への福祉サービス提供の法的形態が、措置制度から契約制度へ、その重点が移行されることとなった。その結果、契約の当事者、契約締結の強制、契約の内容、契約を実現する手段、契約代金の決定、代金の支払方法、契約の解消を正当化する理由など、多くの契約論上の疑問点や問題点が噴出してきた。 本研究では、介護保険法実施後5年半を経過し、障害者の支援費支給制度が実施されて2年半を経過した現在、障害者をめぐる福祉契約が、どのような特徴をもち機能しているのかを、実態調査を通して明らかにした。調査結果に基づきつつ、成年後見制度や地域福祉権利擁護事業の活用状況も踏まえながら、障害者をめぐる福祉契約のあり方と権利擁護の課題を再検討する。 |

| 値 | By structural reform of social welfare system in 2000, the contract system was introduced also to the field of social welfare for persons with disabilities. However, as a consequence, many problems came about in various contractual processes. For example, concerned party of contract, enforcement of conclusion, contents, means realizing contract, decision of costs, way of paying expenses, reasons justifying cancel etc. In this articie, the authors tried to clarify about characteristics and functions of the contract for welfare for persons with disabilities through the survey that was made on administrative organs and institutions for persons with disabilities. And the authors reconsidered what the contract for welfare for persons with disabilities should be, based on the result of the survey. | |||||
